  1. Introduction

Welcome to Vulcan Concierge, a DBA of Exige Inc. (“Vulcan Concierge,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, mobile applications, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

Please read these Terms carefully, as they contain important information about your legal rights, remedies, and obligations.

  1. Eligibility

By using the Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract. If you are using the Services on behalf of an entity, you represent and warrant that you have the authority to bind such entity to these Terms.

  1. Membership

Vulcan Concierge offers two tiers of membership:

a. Tier 1 – Personal Users and Families: This membership is designed for individuals and families seeking concierge services for personal use.

b. Tier 2 – Business Users: This membership is designed for businesses with a higher volume of requests and allows multiple authorized users under one account.

Both membership tiers grant access to the same range of tasks and services. By signing up for a membership, you agree to pay the applicable membership fees and any other fees associated with the Services.

  1. Partners

Vulcan Concierge works with a network of partners to provide the services requested by our clients. Our partners are carefully vetted and tested to ensure they meet our high standards of quality and professionalism. We reserve the right to terminate our relationship with any partner who fails to meet these standards.

  1. Services

Vulcan Concierge provides a wide range of concierge services to our clients. While we do not impose limitations on the types of tasks or services that clients can request, we reserve the right to refuse tasks that are deemed inappropriate or outside the scope of our abilities.

  1. Payment and Refunds

Clients agree to pay the full amount requested by our partners in return for their services. This amount will be determined and agreed upon via contract prior to the commencement of work. Payments made to our partners are not eligible for a refund unless explicitly stated otherwise by the partner.

Membership fees may be refunded on a prorated basis upon cancellation of the membership. To request a refund, please contact our customer support team.

  1. Cancellation

Memberships may be cancelled at any time by contacting our customer support team. Upon cancellation, you may be eligible for a prorated refund of your membership fees, as outlined in Section 6.

  1. Data Privacy

Vulcan Concierge is committed to maintaining the privacy and security of our clients’ information. We store client data through WordPress and Woocommerce, and access is limited to authorized Vulcan Concierge administrators. We will not disclose any client information to friends or family members unless authorized by the client themselves.

  1. Dispute Resolution

Vulcan Concierge will handle any disputes or complaints between clients and partners. In the event that a partner’s work does not meet the agreed-upon expectations, we may, at our discretion, arrange for the partner to redo their work at no additional cost to the client. To initiate the dispute resolution process, please contact our customer support team.

  1. Website and Mobile Application Usage

Our website is available for public viewing and membership application. The members’ portal and mobile application are accessible only to registered members through a secure login process. By using our website, mobile application, or any other platform through which you access our Services, you agree to comply with all applicable laws, regulations, and these Terms.

  1. Modification of Terms

We reserve the right to modify these Terms of Service at any time, at our sole discretion. We will notify clients of any changes to the Terms via email. Clients will have the option to accept or reject the changes. By rejecting the changes, clients are choosing to cancel their Vulcan Concierge subscription and membership. By continuing to use the Services after receiving notice of the changes, clients are deemed to have accepted the updated Terms. It is the clients’ responsibility to regularly review these Terms for any updates or modifications.

  1. Indemnification and Limitation of Liability

Clients agree to indemnify and hold harmless Vulcan Concierge, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with their use of the Services, their engagement with our partners, or any breach of these Terms.

Vulcan Concierge is not liable for any claims, damages, losses, or expenses resulting from the work provided by our partners, nor are we liable for any claims, damages, losses, or expenses incurred by partners as a result of their engagement with our clients.

In no event shall Vulcan Concierge be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of, or inability to access or use, the Services; (b) any conduct or content of any third party on the Services, including, without limitation, any defamatory, offensive, or illegal conduct of other users or third parties; or (c) unauthorized access, use, or alteration of your transmissions or content.

  1. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Exige Inc. is registered, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction in order to resolve any dispute arising out of or in connection with these Terms or your use of the Services.

  1. Miscellaneous

These Terms, together with any other policies or agreements referenced herein, constitute the entire agreement between you and Vulcan Concierge concerning your use of the Services and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and Vulcan Concierge with respect to the subject matter hereof.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Any failure by Vulcan Concierge to enforce any provision of these Terms shall not be deemed a waiver of such provision.
